Amendment to Legislative Decree 81/08: What does it mean for companies?

Legislative Decree 81/08, which regulates the rules for health and safety in the workplace, has recently undergone significant changes with the entry into force of Legislative Decree no. 48 of 4 May 2023.

These changes introduce urgent measures to strengthen workplace safety and accident prevention regulations, as well as to promote social inclusion and access to the workforce. This requires strengthened inspections, more comprehensive training, and the importance of adequate internal control and verification tools.

  • Article 14 contains amendments to Legislative Decree 81/08 (discussed below).
  • Article 15 establishes the need to share data from public and private entities with the National Labor Inspectorate and the Guardia di Finanza (Financial Police) in order to guide inspections regarding workplace health and safety, undeclared work, and tax evasion or omission.
  • Article 16 provides for the strengthening of workplace health and safety inspections in the Sicilian Region and the autonomous provinces of Trento and Bolzano, making use of adequately qualified personnel already in service.
  • Article 17 establishes a fund of €10 million for 2023 (€2 million in subsequent years) to compensate the families of students who are victims of injuries during training activities.
  • This article also defines measures to revise the soft skills and orientation programs. In particular, the need for transversal skills programs to be consistent with the curriculum is highlighted, qualitative monitoring of programs has been established, and more stringent requirements have been identified for companies that host students on programs (integration of the DVR, more specific skills and competencies).
  • Article 18 extends insurance coverage to students and staff in schools and the vocational education and training system.

While companies will need to comply with these new legislative provisions as soon as possible to avoid penalties, it’s important to emphasize that these measures can also offer a series of opportunities to adopt advanced digital solutions and respond effectively to the new regulatory provisions.

In this context, control actions and procedures will play a key role, such as comprehensive management of all phases of planning, conducting, and recording corporate audits, to monitor and track the controls performed, ensuring regulatory compliance and the efficient management of inspection activities required by organizational, regulatory, and legislative frameworks.

Specific training on health and safety

Another significant change concerns the obligation for companies to provide specific health and safety training to their employees. Companies must now ensure that all employees have adequate knowledge and training regarding the risks associated with their work and the preventive measures to be adopted. This is essential for creating a safe work environment and preventing accidents or occupational diseases. It will therefore be essential for companies to have dedicated corporate training tools available that allow them to plan training activities, create customized courses, track training activities, and ensure in-depth knowledge of safety procedures.

Internal control and verification tools

Finally, the changes highlight the importance of having adequate internal control and verification tools. Companies must be able to constantly monitor compliance with safety regulations, assess risks, and implement preventative measures, including through the creation of customized checklists (checklists), conducting regular inspections, and efficiently managing the results.
