Terms of use of the website “www.sinergest.com”

1. General provisions

1.1 For the purposes of these terms of use, User means the person who makes use of the services offered by the website www.sinergest.com, whether they limit themselves to consulting the information contained therein or proceed to use the reserved areas.

1.2 The use of the site is governed by these terms of use, the acceptance of which constitutes an agreement between the User and the Service Owner and is given by the mere fact of browsing the Web pages.

1.3 Additional rules and conditions may be prepared by the Service Owner to regulate individual services offered on the Site: the User must comply with them in order to make use of the related goods and services.

1.4 The law applicable to the relationships arising from the use of the service is Italian law, in light of which these terms of use must also be interpreted.

1.6 The Service Owner reserves the right to make, at any time, even substantial changes to these terms of use, informing the User by publishing them on the Site. Subsequent access after the modification implies the User’s full acceptance of the new terms of use.

1.7 The text includes terms that are purely IT-related, commonly recognized and of unambiguous meaning which, unless expressly stated otherwise, are assumed to be known and understood by the user of the site and the services offered through it.

2. User requirements and obligations.

2.1 The User undertakes not to access reserved areas if they are not the true and legitimate holder of the access credentials.

3. Further obligations of the User.

3.1 The User is required to use the website and the services offered through it in full and continual compliance with the law, public order and public morals (including customary rules attributable to the so-called Netiquette), and with what is established in these terms of use.

3.2 If the User accesses their reserved area to update or modify their personal data, they undertake to provide true information strictly necessary for the use of the services provided by the company.

3.3 Once the account is activated, the User undertakes to use it, and in any case the related user-id and password, lawfully and correctly, also in light of the legal consequences connected to such use.

3.4 The User must keep the user-id and password related to their account with due care and diligence, and in case of theft or loss they are obliged to notify it promptly and request their deactivation.

3.5 The User is obliged to promptly notify the Service Owner of any loss or theft of the access credentials (user-id and password): in the absence of such notification, all expressions of intent, acts and facts producing legal effects carried out through the User’s account will be indisputably attributed to them.

3.6 Sinergest Srl shall not be liable in any way for the unlawful consultation of personal data contained in the reserved area by unauthorized third parties who have become aware of the User’s authentication credentials due to the User’s negligence.

3.7 The User undertakes not to in any way disturb other Users’ use of the service.

3.8 The User is prohibited from copying or otherwise reproducing the website’s contents, in whole or in part, for uses other than strictly personal use and, in any case, for commercial uses, without prejudice to the provisions of copyright and/or industrial property law.

3.9 If the User publishes on a Social Network content from Sinergest Srl’s site through their own account, they assume all responsibility that may arise therefrom.

4. Obligations, warranties and disclaimers of the Service Owner.

4.1 The Service Owner undertakes to provide the User with online availability of the website and the services offered through it, as well as the communication tools connected thereto, taking care of their implementation in line with the current state of evolution of IT tools.

4.2 Without prejudice to the foregoing, the Service Owner, considering that some pages of the Site are hosted on and managed by third-party web spaces, assumes no responsibility for any interruption and/or suspension of the provided service and/or any other limitation of the service’s availability in any part, due to technical problems of its own and/or third parties caused by factors or circumstances beyond its control. In case of problems in the functioning of parts of the site, the user may report them to info@sinergest.com

4.3 The Service Owner may use alternative and/or ancillary communication and/or publishing tools to the Site to make the services offered to Users available, including, by way of example and not limited to, linking or mirroring techniques.

4.4 The Service Owner is not responsible for any uses of this website and the services offered through it carried out in violation of law, public morals or public order, or in breach of these terms of use.

4.5 The Service Owner offers no guarantee as to the updating of the information entered on the site.

4.6 The Service Owner exercises no control over links to other websites and their content present on its pages. If the link refers to a Site that offers additional services through the Service Owner, the related use will be governed by the terms of use prepared by the provider of that service.

4.7 The Service Owner is not liable for any damage and/or loss and/or malfunction and/or prejudice of any kind that may occur to the User’s electronic device from the use of the service provided by it, nor for any contamination of the IT system resulting from access, interconnection, downloading of material and computer programs from the site; the related repair/restoration expenses remain the User’s responsibility.

5. Intellectual property

5.1 This website is protected by the current Italian copyright legislation.

5.2 The User is prohibited from copying or otherwise acquiring, publishing, disseminating, transmitting or otherwise making available, even partially and/or after modifications, the material published on the website, except in cases where this is expressly permitted on the site, such as for posting certain content on Social Networks.

6. Final provisions

6.1 The Service Owner reserves the unilateral right to modify, suspend or discontinue the website and the services offered through it, as well as to modify, suspend or terminate the account and the communication tools connected to an individual User.

6.2 The Service Owner also reserves the right to pursue future business and advertising initiatives, including paid ones, through the use on the website of any third-party logo and/or trademark, including advertising banners and any other advertising insertion for the direct and/or indirect promotion and marketing of any good, product and service.

7. Jurisdiction

7.1 The use of the services provided by the Service Owner through the website is not authorized in jurisdictions that do not recognize the validity of all provisions issued by these terms of use, including, without limitation, this paragraph.
